FitShoe
Health Data: Notice and Consent
To measure your feet and recommend shoes, FitShoe needs to process photos and measurements of your feet. The law treats this data as health data, so we ask for a consent just for it, separate from the Terms and the Privacy Policy.
FitShoe is not a medical device. The measurements and observations about your foot are estimates for choosing footwear. The app does not diagnose, treat or prevent any health condition, and it does not replace a health professional. If you feel pain or have any health problem, see a professional.
1. Who processes the data
Alpha Tech — Douglas dos S. Silva, a sole proprietor (empresário individual), CNPJ 37.595.093/0001-54, based in Araraquara/SP, Brazil. Contact and requests: contatofitshoe@alphatechdev.com.br.
2. Which data is health data
- the photos of your feet, of the inner side of the foot and, if you wish, of the sole of a worn shoe;
- your measurements (length and width of each foot);
- your Foot Passport: toe shape, whether there is a bunion, arch type, instep height, stride type, the main use you choose and the descriptive summary of the shape of the foot;
- the complaints you declare yourself (plantar fasciitis and shin splints).
3. What we use it for
Only to measure your feet, build your Foot Passport, recommend shoes and sizes, and show, in the Store checker, how a shoe matches your Passport. The complaints you declare are used only to adjust the scores and fit warnings of the shoe suggestions. We do not use this data for any other purpose, we do not sell it and we do not use it for advertising.
4. What happens to your photos
- Measurement (free): the photo goes to our API and to our measurement service, which returns the measurements. The photo is then discarded. Only the measurements stay.
- Complete Foot Analysis (1 analysis credit): your 3 or 4 photos (both feet seen from above, the inner side of the foot and, if you wish, the sole of a worn shoe) are sent by our API to the Claude artificial intelligence, from Anthropic, in the USA, which returns the reading of the shape of the foot. The photos are discarded; only the result stays, in your Passport. The complaints you declare are not sent to the AI.
- Store checker by photo (1 photo credit): the photo of the shoe or of the label is sent to the same AI, which identifies brand and model. The photo is discarded. The record of the result stays.
- None of these transfers carries your e-mail, the account identifier or your measurements.
5. Legal basis and your choice
Processing of health data is based on your specific and prominent consent (LGPD art. 11, I; GDPR art. 9(2)(a)). Consent is your choice. Without it, we cannot measure your feet, build the Passport or use the Store checker. By consenting, you are also aware that the photos of the Complete Analysis and of the Store checker by photo are sent to Anthropic, in the USA.
6. Withdrawing consent
- You can withdraw consent at any time, in the app, under Account, “Withdraw consent”. The app warns you before confirming.
- Withdrawing erases your measurements and your Foot Passport, and removes from the Store checker records what came from your foot (score, verdict and recommended size); the shoe you looked up stays in the record. Your credits stay in the account.
- Withdrawing does not affect what was done before the withdrawal. To measure or analyze again, you must consent again and measure again.
- Deleting the account also erases all this data.
7. How long we keep it
Photos are not kept. Measurements and the Foot Passport stay until you withdraw consent or delete the account; a new analysis replaces the previous Passport.
8. International transfer
Anthropic is in the United States, so the photos of the Complete Analysis and of the Store checker by photo leave Brazil (and, if you are in the European Union, the European Economic Area). This transfer is part of the consent you give us here. Where the law requires it, we rely on mechanisms such as standard contractual clauses for the transfer.
9. Your rights
You can ask for access, correction, deletion, portability and information about the processing of your health data, and withdraw consent, as the Privacy Policy explains. Write to contatofitshoe@alphatechdev.com.br. You can also complain to the National Data Protection Authority (ANPD) or, in the European Union, to the data protection authority of your country.
10. Minimum age
FitShoe is for people over 18. See also the Terms of Use.
